or information, sometimes as a purchase product, and sometimes in response
to inquiries or requests, either through the Web site or through other
electronic means connected to or made possible by this site.

Without limitation, access or use of this Web site's resources ("resources"
including any information, materials, services, communications, previews
and project reviews, without limitation) constitutes your agreement to
the Terms of Use described in this document ("Terms of Use"). If you do

resources in any manner. If your use of the Web site or its resources
is on behalf of your employer, you represent that you are authorized to

Use Limitations
Unless otherwise noted the resources on this Web site, including proprietary
trademarks and logos, are the copyrighted property of Designed Instruction
or its third-party licensors. The following usage guidelines and limitations
apply.
Designed Instruction trademarks (e.g., PreKorner, LearningLeads,
and others as established) may not be used except as they appear in documents
prepared by Designed Instruction, or in connection with, and crediting
ownership to, Designed Instruction. Trademark names must always be accompanied
by the designation "TM" (usually, though not required, in subscript or
superscript).
Use of Designed Instruction logos, apart from inclusion in materials prepared
by Designed Instruction, is forbidden without written consent. You may
request permission in writing via email or traditional mail, at the information
contact address provided on this Web site. To expedite such consent, be
prepared upon request to provide a sample of the intended logo use, as
well as a description of the context, product, or materials to which you
wish to connect or attach the logo. As a standard policy, the logo font
and color is never altered, and the tagline, where one exists, is typically
included wherever possible or appropriate.
Document,
Publication, and Product Usage
Unless otherwise noted, you are allowed to print, copy, and distribute
traditional and/or electronic documents and publications (e.g., research
briefs, strategy and idea papers, activities, and other instructional
and/or informational resources) that have been provided at no charge by
Designed instruction, subject to your agreement with the following:
(a.) The
use is for educational purposes (pre K through grade 16), or is strictly
informational in nature. Any use for educational purposes with children
or youth, including reasonable adaptation and modification intended to
enhance learning, or for the purpose of sharing among other education
field professionals or parents with this intent, is allowed and encouraged.
Commercial use, including marketing, and including non-profit business-building
ventures, will be prosecuted.
(b.) Modifications to resources are not made, except as an attempt to
address appropriate educational intent as described above in (a). No distribution
of graphics outside of the accompanying text document, or quotation of
written material intentionally out of context, is allowed.
(c.) Appropriate intellectual credit and copyright notice, and logo and
trademark display if necessary, and other proprietary notices are included
and displayed on all printed, copied, and distributed materials.
(d.) These permissions may be revoked upon notice by Designed Instruction,
and upon such notice, you will immediately stop all activities related
to this permission.
Products that are purchased are subject to the identical limitations described
for free resources above in (a) through (d), except for the provision
that copying and distribution must in all cases be confined to the materials
intended to promote student learning in a classroom, home, or similar
educational environment. Examples of these types of materials include
handouts, student sheets, student texts, activities, and so forth.
Purchase products cannot be copied, distributed, or "given" by any means,
electronically or otherwise, to others who have not purchased the product,
including other educators, to use for free.
Note:
Individuals
or organizations who wish to reprint and/or distribute our original
content are encouraged, if their purposes are to directly assist student
learning or freely share useful information with the educational community.
Typically, these criteria are met by teachers and parents who
work directly with students, and by groups or organizations that freely
provide information to teachers and parents. Read our Education

Disclaimers
All resources on this Web site are provided "as-is" without warranty of
any kind. Designed Instruction hereby disclaims all warranties either
expressed or implied, including but not limited to:
(a.) Suitability for a particular purpose, instructional or otherwise.
(b.) Timeliness of "newness" of information or foundational research,
or scientific veracity that may fade or change with time.
(c.) Safety, including both physical and psychological, in or out of classrooms,
and other issues related to safety and/or implied claims of safe procedures.
With all the resources it produces, or supplies via educator submission
or from third-party suppliers or licensors, Designed Instruction entrusts
full responsibility to its consumers, clients and educators, for both
its free resources and for its purchase products. As the user, you assume
full risk and responsibility for appropriate use and implementation, including
safety and other precautionary measures, and agree that in no event shall
Designed Instruction, its third-party suppliers or licensors, or its respective
partners or participating community, be held liable for any special, indirect,
or consequential damages whatsoever resulting from use, in or out of classroom,
or from loss of use, business or profits, whether in an action of contract
or negligence, arising out of or in connection with the use of this Web
site, use or performance of instructional resources, documents, publications,
products, research, services, or other information from this Web site.
General
The Terms of Use constitute the entire agreement between you and Designed
instruction and govern your use of this Web site, and the resources contained
therein. Designed Instruction controls and operates this Web site from
its office in Sundown, Texas, in the United States of America, and makes
no representation that this Web site or its resources are specifically
appropriate or available for use in other locations. If you use this Web
site or its resources from other locations, you are responsible for compliance
with applicable local laws including but not limited to the export and
import regulations of other countries. You agree that the resources on
this Web site are subject to the U.S. Export Administration Laws and Regulations,
and that no resources from this Web site, nor any product(s) derived from
these resources, will be acquired for, transferred, or diverted to proscribed
or embargoed countries or their nationals (including Afghanistan, Cuba,
Iran, Iraq, Libya, North Korea, Syria, Serbia and Sudan - subject to change
without notice) nor used in any way that is contrary to U.S. law. You

the court should endeavor to give effect the parties' intentions as reflected
in the Terms of Use, and that other provisions in the Terms of Use remain
in effect.
